Well, as counting the original wing commander as abandonware,
IF you should get an awnser from someone who has something to say about it, who gives you permission to spread it as "abandonware"(giving permission as in not responding to ten "do you mind if...." e-mails, or actually giving permission)
losing/scratching a disc is not questionable, the person who distributes, in nomatter what form is responsible, if you bought the game, you are allowed to have it in the distribution you bought.. even obtain a copy from a 'friend'(you have bought it, you own it!)
Also. most people will not buy a game that has to be played through an emulator.
