Wing Commander CIC

When I insert the first CD of Kilrathi Saga a window appears saying that DirectX 2 will now be installed, and it immediately starts to copy files without requesting a confirmation!
Who can tell me if this really overwrites a newer DirectX or if it detects the newer DirectX and therefore does not overwrite it?
